Members enrolled in the Family Care program with My Choice Family Care have the following rights:

You have the right to be free from unlawful discrimination in applying for or receiving the Family Care benefit.

You have the right to know that information about you that you share with the Managed Care Organization will be recorded accurately and will remain confidential.

When you apply for the Family Care program with My Choice Family Care, you have the right to prompt eligibility determination. If you are eligible for the program, you are entitled to receive the information and assistance you will need to complete your enrollment and receive the information you need regarding cost-share if it applies to you.

  • You have the right to receive access to personal, program and service system information.
  • You have the right to receive access to information about all services and supports available in the Family Care benefit package. Click here to view our Member Handbook.
  • You have the right to make the choice to enroll in the Care Management Organization, if eligible, and to dis-enroll at any time for any reason.
  • You have the right to receive information about and access to all services of the Resource Centers and the Managed Care Organization.
  • You have the right to participate in planning for and evaluating your services.

You have the right to receive support from your team in identifying your needs desired personal outcomes.

You have the right to be treated with dignity and respect and to receive fair treatment from the staff and contractors of My Choice Family Care.

You have the right to manage and control your own services to the extent you are willing and able.

You have the right to receive treatment or services in the living situation which you and your team choose.

You have the right to receive services from culturally competent providers and information on how to access those providers. Click here to view our Provider Directory.

You have the right to be covered by other Member rights such as the rights of a nursing home resident or the rights of a group home resident.

You have the right to receive assistance and support in understanding your rights and resolving grievances and appeals.

You have the right to request a private room in residential settings and to have the procedures explained regarding your request, and the procedure if a private room is not immediately available.

Member Responsibilities

Service from the Managed Care Organization depends on you, your family, significant other(s), and all who are concerned about you. Your Team will work closely with all of you to try to meet your long-term care needs. As a Member enrolled in the Family Care program with My Choice Family Care, you have the following responsibilities:

You have the responsibility to provide full, correct and truthful information requested by your Team or providers so we can determine eligibility, cost-share or meet reporting requirements.

You have the responsibility to allow the release of records as needed.

You have the responsibility to participate in the development of your Member Centered Plan.

You have the responsibility to use benefits you have from other programs or insurance to pay for services before they are charged to the Managed Care Organization.

You have the responsibility to use providers contracted with the My Choice Family Care unless you and your team agree otherwise. Click here to view our Provider Directory.

You have the responsibility to treat staff and service providers with dignity and respect.

You have the responsibility to pay cost share or room and board charges on time.

You have the responsibility to comply with emergency care procedures.

You have the responsibility to keep your Team informed about changes in health or ability to do daily activities, financial status, or living arrangements that might affect eligibility for benefits or services.

You have the responsibility to report any suspicions or evidence of fraud or abuse of the Family Care program on the part of providers, other Members or MCO employees. You can report any suspicions of fraud or abuse online at www.reportfraud.wisconsin.gov.

You have the responsibility to keep your Team informed about changes in your address or phone number.

You have the responsibility to notify My Choice Family Care if you plan to move out of your Family Care county.
